TERMS AND CONDITIONS

Payment Terms

Payment must be received by us at least 28 days prior to the scheduled date of surgery. If you are paying the full amount yourself, please make a transfer to us using BG 5575-1440. Please state your first and last name as the payment reference. If your scheduled surgery date is within 28 days of the booking date, payment must be made as soon as possible in order to retain your scheduled surgery date. If you are paying all or part of the amount by instalment, deduct that amount from the payment made in accordance with the above.

The application for payment by instalments must be completed at least 28 days prior to the scheduled date of surgery.

If the above payment terms are not fulfilled, the clinic reserves the right to cancel the scheduled surgery date.

Cancellation/Refund

The Patient has a full right of cancellation and is entitled to a full refund if the surgery is cancelled at least 28 days before the scheduled procedure. Any cancellation or rescheduling made thereafter and within 28 days of the scheduled surgery date will be subject to the following fee: 21–28 days before the surgery date: SEK 5,000; 14–20 days before the surgery date: 25% of the surgery fee; 2–13 days before the surgery date: 50% of the surgery fee; less than 2 days before the surgery date: 100% of the surgery fee.

If the Patient fails to comply with the pre-operative instructions regarding fasting and hygiene washing, thereby making it impossible to perform the surgery on the scheduled date, the Patient shall be liable for the full amount.

ACPK reserves the right to cancel the surgery if payment has not been made on time.

In the event of illness, the surgery date will be rescheduled to the first available appointment at no additional cost, provided that the Patient has a medical certificate confirming that the Patient should not undergo surgery. If an appointment that has already been rescheduled due to illness is subsequently cancelled, no refund of the surgery fee will be made.

By signing this agreement, the Patient acknowledges and accepts these cancellation terms.

Rights and Conditions

An agreement for surgery has been entered into between Akademiskt Centrum Plastikkirurgi Sweden AB, corporate registration number 559281-1441, (“ACPK”), on the one hand, and (“the Patient”), on the other hand (jointly, the “Parties”), whereby the preceding agreement entitled “Booking Agreement” establishes the Parties and the terms and conditions applicable to the surgery governed by this agreement.

The Surgery and the Result

The Parties agree on the nature of the surgery and how it is to be performed. The Surgeon will use their knowledge, professional skills and experience to achieve the best possible result based on the circumstances and conditions applicable to the Patient.

The Patient is aware of and accepts that medicine and surgery are not exact sciences and that the Patient is therefore not guaranteed a specific result in relation to the surgery to be performed. Under no circumstances is the Patient entitled to demand a refund of any amount paid due to dissatisfaction with the result.

Before and After Surgery

The Parties have discussed the conditions required for healing and a good result. The Patient confirms that the Patient has received information about and understood how the Patient is to act and care for themselves both before and after the surgery.

The Patient is aware that an uncomplicated healing process and a good result depend on the Patient carefully following the instructions provided. The Patient is aware that smoking may have a very negative impact on the healing process.

The Patient hereby confirms that the Patient shall not hold ACPK and/or the Surgeon liable in cases where complications occur as a result of the Patient’s own actions.

Additional Surgery/Correction

In certain cases, a minor correction may be required to address results that ACPK does not consider to be normal. Examples of such corrections include correction of scars that may arise following poor wound healing and correction of “dog ears”. Such corrections are performed free of charge if carried out under local anaesthesia; otherwise, a fee of SEK 8,000 will be charged for general anaesthesia.

Other types of corrective surgery, including but not limited to correction of unevenness following liposuction, additional procedures that do not involve scar correction or removal of dog ears, are performed at a cost of SEK 4,000 under local anaesthesia and SEK 8,000 under general anaesthesia.

Please note that a new operation of the same type as the original procedure will never be offered as corrective surgery.

For the above correction terms to apply, the Patient must have undergone a documented postoperative treatment programme in accordance with the plastic surgeon’s recommendations. This may include, but is not limited to, lymphatic massage, Venus Legacy, scar treatment with Venus Viva, or similar treatments.

The decision regarding this type of correction is made by the Patient’s plastic surgeon together with the clinic management, and the corrective procedure must be performed within 12 months of the primary surgery. Such procedures are performed on specific dates determined by ACPK.

For corrective procedures following body-contouring surgery (including, for example, liposuction, abdominoplasty, thigh lift, arm lift, body contouring, etc.) as well as breast procedures, the BMI must remain constant within +/- 2 kg of the level at the time of surgery.

The need for correction arising as a result of the Patient’s failure to comply with the applicable postoperative guidelines is not covered by this clause.

Liability

ACPK is only liable for direct damage caused by negligence on the part of ACPK and shall have no other liability arising from the surgery, including, for example, any complications or undesirable results.

ACPK and the Surgeon are not, for example, liable for incorrectly manufactured medical products used during the surgery.

Information Regarding the Surgery

ACPK, the Surgeon and the Patient have discussed the surgery in question, the nature of the procedure and how the procedure is to be planned and performed, including, among other things, the methods to be used and, where applicable, which implants or equivalent products are to be used, as well as their respective advantages and disadvantages.

In addition, the Patient has been informed of the risks of complications that may occur in connection with surgery, such as scarring, risk of infection, reduced sensation, etc., some of which may, however, be temporary.

By signing the agreement, the Patient confirms:

  • That the Patient has received satisfactory information regarding the surgery, including the nature of the procedure, the risks associated with the procedure and how the procedure is to be performed;

  • That the Patient is aware of and accepts that there are risks associated with the surgery and that complications may occur;

  • That the Patient is aware of and accepts that permanent scars will remain following the surgery and that the appearance of scars is affected by biological healing, which is individual to each person and cannot be predicted;

  • That the Patient is aware that infection, bleeding and bruising associated with the surgery may delay the healing process;

  • That the Patient is aware of and accepts that reduced sensation or numbness in the surgical area is a consequence of surgery and may therefore occur in the surgical area;

  • That the Patient may experience permanent weakness in muscles and nerves; and

  • That the Patient has received answers to all questions the Patient has had in relation to the surgery and the entering into of this agreement.

Confirmation

The Patient confirms that the Patient has read and understood this agreement and that all questions concerning the surgery and this agreement have been answered.

The Patient further confirms that the provisions of this agreement accurately reflect the agreement between the Parties and that no agreements, guarantees or representations in addition to those stated in this document have been provided by ACPK, the Surgeon or any other person.
